Introduction and relationship
This Creator Agreement (“Agreement”) governs the relationship between হবে নাকি Coffee? and any user who registers as a creator on the platform. This Agreement is in addition to our general Terms and Conditions— in the event of a conflict, this Agreement takes precedence on creator-specific matters.
You are an independent creator— not an employee, agent, partner, or representative of the platform. You retain full independence and responsibility over your offers, pricing, and relationship with supporters.
Eligibility and onboarding
- You must be at least 14 to publish offers as a creator (18+ for payouts).
- KYC verification with a valid National ID (NID) is required before your first payout.
- You must accept the current version of this Agreement when publishing your first offer/service. The platform records the timestamp and version of your acceptance.
- For material changes to this Agreement, we may require you to re-accept the updated version — publishing new offers or payouts may be restricted until you do.
Commission and fee schedule
We deduct a platform fee (commission) from each successful transaction at the following rates (in addition to payment gateway charges — see the full schedule in our Terms):
- Coffee gifts / support: 5%
- Newsletter — pay-per-post: 10%
- Newsletter — subscription/membership: 8%
- Shop — digital products: 10%
- Shop — physical products: 5%
Alternative: Platform subscription. Instead of per-transaction fees, you may subscribe to a Basic, Pro, or Ultra flat-fee plan — within a stated monthly transaction/volume cap, the fee for that service becomes 0%. See plans and pricing on the creator dashboard.
Fee changes will be notified at least 30 days in advance.
Content ownership and licence
You retain ownership of all content, services, and digital products you publish. You grant us a limited, non-exclusive licence to host, display, and promote your content to operate the platform. You are solely responsible for the legality, ownership, and non-infringement of your content.
Creator obligations
- Clearly describe your offer’s pricing, delivery terms, and conditions.
- Deliver on the promised quality and timeline.
- KYC information (NID, selfie) must be true and your own — false information is a criminal offence under the Penal Code 1860 (ss. 465–471).
- You are solely responsible for determining, paying, and reporting applicable income tax/VAT on your earnings — see our Tax and Reporting Notice.
- Comply with the Acceptable Use Policy— avoid prohibited content, fraud, or platform abuse.
Payout terms
- KYC required: Valid NID-based KYC verification before your first withdrawal.
- Minimum withdrawal: BDT 500.
- Payout methods: bKash, Nagad, Rocket, or bank transfer.
- Processing time: Typically 1–5 business days after approval, subject to MFS/bank processing times.
- Fund withholding: We reserve the right to delay or suspend payouts in cases of suspected fraud, Agreement violations, active chargeback disputes, or payment gateway restrictions.
Suspension and termination
We may suspend or terminate a creator account without prior notice in the following cases:
- Violation of this Agreement or the Acceptable Use Policy.
- Fraudulent or money-laundering-related activity.
- Repeated chargebacks, reports, or platform abuse.
- False or fraudulent KYC information.
- Legal obligation (court order or government directive).
The reason and date of suspension are retained in platform records. Contact us to discuss reactivation.
Agreement acceptance and versioning
When you accept this Agreement on the creator dashboard, the platform records the timestamp and version number of your acceptance — this serves as evidence of the agreement between you and the platform.
Indemnification
You agree to indemnify the platform against any claims, damages, or legal action arising from your offers, content, violation of this Agreement, or infringement of any third-party rights.
Dispute resolution and governing law
In the event of a dispute, contact us first at support@hobenakicoffee.com. If unresolved, arbitration under the Arbitration Act 2001 of Bangladesh or the jurisdiction of the competent courts of Bangladesh applies — see details in our Terms. This Agreement is governed by the applicable laws of Bangladesh.
Changes to this Agreement
For significant changes, we will provide at least 30 days’ notice via email or platform notification. Some changes may require re-acceptance.
